Request for Deferred Disposition

This form allows you to make your request for Deferred Disposition, but does NOT GUARANTEE you will be granted the Deferral. You may not request a deferral if you are under the age of 17 or charged with an offense under the Texas Alcohol Beverage Code, Tobacco Offense or violations of the Texas Penal Code. All requests MUST include the DEFERRED DISPOSITION REQUEST and a COPY OF YOUR DRIVER'S LICENSE. Additionally, CURRENT INSURANCE must also be provided if the offense involves FAILURE TO MAINTAIN FINANCIAL RESPONSIBILITY. Incomplete submission will be denied. Your request will be reviewed by Court staff and you will be contacted by email once a determination has been reached on your eligibility. Allow up to 10 business days for court staff to process your request. If you are granted Deferral, a Deferral Agreement will be emailed to you along with your payment requirements. You must meet the minimum qualification when completing this form. DO NOT PAY YOUR CITATION UNTIL YOU HAVE RECEIVED A NOTICE FROM THE COURT TO DO SO, OR YOU WILL FORFEIT YOUR RIGHT TO REQUEST DEFERRED AND A CONVICTION MAY BE ENTERED AGAINST YOU.
I meet the following requirements of eligibility to request the deferred (Please check all boxes):
1) I waive my right to trial and enter my plea of NO CONTEST. I was charged with an offense eligible for Deferred Disposition and have verified this fact with the court.
2) In addition, you must pay the fine amount and applicable fees in full after your request is approved.
3) You are not currently on deferred disposition with the City of Sherman for a previous citation.
4) You must not have been cited with speeding 25 miles per hour or more over the posted speed limit.
5) You will not be eligible for deferred disposition if you hold a commercial driver's license (CDL), or held a commercial driver's license when the offense was committed regardless of whether you were in a commercial vehicle or personal vehicle or car.
6) You will not be eligible for deferred disposition if the offense occurred within a construction zone or within a construction zone while workers present.
7) If you are under the age of 25 and charged with a moving violation, you will be required to complete a six-hour driver's safety course as a term of your deferral to be submitted on or before completion of deferment of 90 days. (Initial if under age 25)
8) You must not be convicted of any other violations of the law which occur during the deferment period of 90 days.
9) If the above conditions are not met your case will be set on a Show Cause before the judge to discuss further action.
